By signing up for, or otherwise visiting, using, or engaging with our website (“clippingbuzz.com“) and services, or accessing any content or material made available by Clipping Buzz through the Service, You (“you”, client, “user”, “customer”) enter into a binding contract with Clipping Buzz. The Clipping Buzz Service also contains the Customer Portal, which is covered in more detail under the Customer Portal section.
These Terms and Conditions of Use (“Terms”) and our Privacy Policy are part of your agreement with us. (The Terms, Privacy Policy, and any additional terms to which you accept, as mentioned in the Entire Agreement section, are collectively referred to as the “Agreements.”) If you want to review the terms of the Agreements, you can see the most recent version of the Agreements on Clipping Buzz. You confirm having read and understood the Agreements, accepting them, and agreeing to be bound by them. You should not access or use the Site if you do not agree to any of these Terms. The term “Content” refers to any text, materials, documents, pictures, graphics, logos, design, audio, video, and other information offered from or on the Site, as well as any information uploaded to and/or downloaded from the Site.
Please carefully read the Agreements. They include critical information regarding the Clipping Buzz Services we provide you as well as any charges, taxes, and fees we charge you.
To use the Clipping Buzz Service and access the Content, you must (1) be 18 or older, or 13 or older with the consent of your parent or guardian to the Agreements; (2) have the power to enter into a binding contract with us and not be barred from doing so under any applicable laws; and (3) reside in a country where the Site is available. You also agree that any registration information you submit to Clipping Buzz is true, accurate, and complete, and that you will maintain it in that state at all times.
We have the right to make modifications to the Agreements at any time. It is your duty to monitor these Agreements for updates on a regular basis. Your continued use of the Site after the modifications are posted indicates that you acknowledge and consent to the changes. Clipping Buzz offers you a personal, non-exclusive, non-transferable, limited right to enter and use the Site as long as you comply with these Agreements.
Clipping Buzz will make reasonable measures to maintain the Clipping Buzz Site’s functionality. However, technical difficulties or maintenance may cause minor outages from time to time. Clipping Buzz reserves the right, to the extent permitted by applicable law, to modify or discontinue, temporarily or permanently, functions and features of the Clipping Buzz Service, with or without notice, at any time and without liability to you, except where prohibited by law, for any interruption, modification, or discontinuation of the Clipping Buzz Service or any function or feature thereof. Clipping Buzz has no duty to maintain, support, upgrade, or update the Site, or to offer all or any specified content through the Site. This clause will be enforced to the degree permitted by law. Clipping Buzz and/or the owners of any Content may, at any time and without notice, remove any such Content to the extent authorized by applicable law.

4.2 Customer Portal, Account Creation, and Passwords
To use certain products and services of the Service, the User may be required to register with Clipping Buzz and choose a password. Clipping Buzz must receive correct, comprehensive, and up-to-date registration information from the user. Failure to do so shall constitute a breach of this Agreement, and User’s account may be terminated immediately. You are solely responsible for keeping your account information, including your password, secure, and for any and all activity that occurs under your account. You undertake to notify Clipping Buzz immediately of any unauthorized use of your account or password, as well as any other security violation. You may, nevertheless, be held accountable for any losses suffered by Clipping Buzz or any other user or visitor to the Site as a result of someone else using your username, password, or account.
Clipping Buzz works with third-party programs, websites, and services, such as Shopify, PayPal, BrickFTP, Heroku, HelpScout, Smile.io, and Stripe (“Third-Party Applications”), to provide you with content, products, and/or services. These Third-Party Applications may have their own terms and conditions of use and privacy policies, and your use of them will be regulated and subject to those terms and conditions and privacy policies. You understand and agree that Clipping Buzz does not endorse and is not responsible or liable for any Third-Party Application’s behavior, features, or content, or for any transaction you may enter into with the provider of any such Third-Party Applications.
Clipping Buzz users may post, upload, and/or contribute (“post”) content to the Site in order to get services (such as photographs, text, messages, information, and/or other types of content) (“User Content”). To prevent ambiguity, “User Content” refers to any such content posted to the Customer Service Portal (“the Portal”) or any other area of the Site.
You represent and warrant that, with respect to any User Content you post on the Site, (1) you have the right to post such User Content, and (2) such User Content, or its use by Clipping Buzz as contemplated by the Agreements, does not violate the Agreements, applicable law, or the intellectual property (including without limitation copyright), publicity, personality, or other rights of others, or imply any affiliation with or endorsement of you or your User Content by Clipping Buzz of any kind.
Clipping Buzz has the option, but not the obligation, to monitor, review, or edit User Content. Clipping Buzz reserves the right to remove or disable access to any User Content or account for any or no reason, including, but not limited to, User Content that violates the Agreements in Clipping Buzz’s sole judgment. Clipping Buzz may carry out these acts without informing you or any third party. We reserve the right to remove or disable access to User Content at our sole discretion, and we make no promises to remove or disable access to any specific User Content.
You are solely liable for all User Content that you submit. Clipping Buzz is not responsible for User Content and does not support any of the opinions expressed in User Content. YOU AGREE THAT IF ANYONE BRINGS A CLAIM AGAINST Clipping Buzz RELATED TO USER CONTENT THAT YOU PROVIDE, YOU WILL INDEMNIFY AND HOLD Clipping Buzz HARMLESS FROM AND AGAINST ALL DAMAGES, LOSSES, AND EXPENSES OF ANY KIND (INCLUDING REASONABLE ATTORNEY FEES AND COSTS) ARISING FROM SUCH CLAIM.
You grant us the right to (1) use the processor, bandwidth, and storage hardware on your Device to facilitate the operation of the Service, (2) provide advertising and other information to you, and (3) allow our business partners to do the same in exchange for the rights granted to you under the Agreements. Commercial reasons, including agreements with third parties, may impact the Content you view, including its selection and placement. Some Content licensed, given to, or otherwise made available by Clipping Buzz may include advertising. Clipping Buzz shall make such Content available to you unmodified in such situations.
Unless you notify the Clipping Buzz in writing, you accept that we may use your photographs on our website (including a link to your homepage) and in our marketing materials.
If you give Clipping Buzz with feedback, ideas, or suggestions in connection with the Clipping Buzz Service or Content (“Feedback”), you recognize that the Feedback is not confidential, and you permit Clipping Buzz to utilize that Feedback without restriction or remuneration to you. Feedback is categorized as User Content.
Clipping Buzz respects intellectual property owners’ rights. Please email us at info@clippingbuzz.com if you believe any Content violates your intellectual property or other rights.
Text, graphics, logos, button icons, pictures, audio clips, digital downloads, data compilations, and software are all the property of Clipping Buzz or its content providers and are protected by UK and international copyright laws. Clipping Buzz owns the compilation of all content on the Site, which is protected by U.K. and international copyright laws. Clipping Buzz or its software suppliers own all software used on (or distributed through) the Site, which is protected by US and international copyright laws. All intellectual property rights are reserved.

We will make reasonable efforts to respond to all Customer Support Queries within a reasonable time frame, but we make no guarantees or warranties of any kind that any Customer Support Queries will be responded to within any specific time frame or that we will be able to satisfactorily answer any such queries.
10.1 Quality Guarantee & Refunds
Clipping Buzz attempts to give high-quality services. If you are dissatisfied with the outcome of your project, we will make reasonable repairs and amendments as needed. All requests for modifications and refunds must be made within 14 days after delivery. We also have the right to cancel any alteration request if the Client’s requirements vary from what was initially asked. Clipping Buzz cannot refund an order if the modified photographs meet the same quality standards as an approved sample image. We understand that things change for reasons beyond our control, therefore we may be able to adapt the photos to match your demands at a lower cost.
Any changes made as part of our quality guarantee are not binding on Clipping Buzz or its affiliated organizations. Payments for quotes can be made directly through Clipping Buzz. No refund will be given if the consumer has downloaded their photographs and is unable to show a valid explanation for their dissatisfaction.
Please contact Customer Support if you believe you are entitled to a refund of any payments paid to Clipping Buzz.
10.2 Prices
Prices for services offered may vary. Clipping Buzz reserves the right to adjust the price of pre-paid work (for work products not yet paid for) and will notify you of any price changes before processing a new order. You accept the new price by continuing to use Clipping Buzz’s Service after the price change takes effect, as authorized by local law. Clipping Buzz retains the right to change our rates on a regular basis, with immediate effect on applicable services. We may not alert clients about these adjustments, but unless there is a separate arrangement with any client, they will notice the pricing before finalizing any new transaction.
10.3 Promotional Offers and Discounts
Clipping Buzz may have promotions in the form of coupon codes or through other means. Clipping Buzz maintains the right to revoke promotional offers or discounts for any reason.
10.4 The Click Customer Loyalty and Referral Program
Clipping Buzz ‘s customer loyalty and referral program is called The Click. Clipping Buzz is only available to clients who refer friends, colleagues, and family members. Clients may not receive incentives using multiple email accounts, and referrals may not earn further benefits using numerous email addresses. Any violation of these rules will be deemed program abuse, and any rewards may be revoked or canceled. Clipping Buzz has the right, for any reason, to cancel or remove any awards.
The purchase may be canceled if the photos of a Client’s order do not match the sample provided with the original quote. Clipping Buzz may give the Client with a fresh quote that can be used to place a separate order. If an order is placed using an order template for which the original quotation supplied was based on a different type or category of photos, Clipping Buzz reserves the right to reject the order and offer the Client with a fresh estimate to place a separate order.
When a Client chooses a turnaround time when making an order, that period begins once the Client has completed uploading all of the photographs to be modified. The clock does not start ticking when the order is submitted.
The Agreements will continue to apply to you until either you or Clipping Buzz terminates them. However, you realize and agree that the perpetual license given by you in connection to User Content, including Feedback, is irrevocable and will remain even if any of the Agreements expire or are terminated for any reason. Clipping Buzz reserves the right to cancel the Agreements or stop your access to the Clipping Buzz Site or Customer Portal at any time, including if you use the Clipping Buzz Service and/or Content illegally or violate the Agreements. To the fullest extent permissible by applicable law, you agree that Clipping Buzz shall have no liability or duty to you in the event that you or Clipping Buzz terminates the Agreements or if Clipping Buzz suspends your access to the Clipping Buzz Service. As permitted by current legislation, this clause will be enforced. The Agreements are always subject to termination by you.
WHILE WE STRIVE TO OFFER THE BEST SERVICE POSSIBLE, YOU UNDERSTAND AND AGREE THAT THE Clipping Buzz SITE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OR CONDITION OF ANY KIND. THE Clipping Buzz SERVICE IS USED AT YOUR OWN RISK. Clipping Buzz and all content owners disclaim any and all warranties and conditions of satisfactory quality, merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by applicable law. The Clipping Buzz Service is not guaranteed to be free of malware or other harmful components by Clipping Buzz or any content owner. In addition, Clipping Buzz MAKES NO REPRESENTATION AND ASSUMES NO LIABILITY FOR ANY THIRD PARTY APPLICATIONS (OR THEIR CONTENT), USER CONTENT, OR ANY OTHER PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY ON OR THROUGH THE Clipping Buzz SERVICE OR ANY HYPERLINKED WEBSITE, OR FEATURED IN ANY BANNER OR OTHER ADVERTISING. You acknowledge and agree that Clipping Buzz has no responsibility or liability for any dealings you may have with third-party suppliers of applications, goods, or services advertised on or via the Clipping Buzz website.
You should use your judgment and exercise caution where necessary when buying a product or service through any medium or environment. ADVICE OR INFORMATION OBTAINED BY YOU FROM Clipping Buzz, WHETHER ORAL OR WRITTEN, SHALL NOT CREATE ANY WARRANTY ON Clipping Buzz’s BEHALF IN THIS REGARD. IF PROHIBITED BY APPLICABLE LAW, SOME PORTIONS OF THIS SECTION MAY NOT APPLY IN SOME JURISDICTIONS.
THIS DOES NOT AFFECT YOUR CONSUMER RIGHTS UNDER THE LAW.
You acknowledge that, to the extent permitted by applicable law, ceasing from using the Clipping Buzz Site shall constitute your SOLE AND EXCLUSIVE REMEDY FOR ANY PROBLEMS OR DISSATISFICATION WITH THE Clipping Buzz SERVICE. As with Clipping Buzz, your sole and exclusive remedy for any issues or dissatisfaction with third party applications or their content is to uninstall and/or stop using any such third party applications. This is true even though Clipping Buzz accepts no liability for third party applications or their content, and even though your relationship with such third party applications may be governed by separate agreements with such third parties, to the extent permitted by applicable law. TO THE MAXIMUM EXTENT PERMITTED BY LAW, Clipping Buzz, ITS OFFICERS, SHAREHOLDERS, EMPLOYEES, AGENTS, DIRECTORS, SUBSIDIARIES, AFFILIATES, SUCCESSORS, ASSIGNS, SUPPLIERS, OR LICENSORS WILL NOT BE LIABLE FOR
(1) ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEM;
(2) ANY LOSS OF USE, DATA, BUSINESS, OR PROFITS (WHETHER DIRECT OR INDIRECT), IN ALL CASES ARISING OUT OF THE USE OR INABILITY TO USE THE Clipping Buzz SERVICE, THIRD PARTY APPLICATIONS, OR THIRD PARTY APPLICATION CONTENT, REGARDLESS OF LEGAL THEORY, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL;
OR (3) TO THE EXTENT PERMITTED BY APPLICABLE LAW, AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE Clipping Buzz SERVICE, THIRD PARTY APPLICATIONS, OR THIRD PARTY APPLICATION CONTENT MORE THAN THE AMOUNTS PAID BY YOU TO Clipping Buzz DURING THE PRIOR TWELVE MONTHS IN QUESTION.
You understand and agree that the Content’s owners and select distributors are intended beneficiaries of the Agreements and have the right to directly enforce the Agreements against you. Except as expressly stated in this section, the Agreements are not intended to transfer rights to anyone other than you and Clipping Buzz, and the Agreements do not create any third-party beneficiary rights. Furthermore, no other person’s consent is required to terminate, rescind, or agree to any amendment, waiver, or settlement of the Agreements.
The Agreements represent the entire understanding between you and Clipping Buzz with regard to their subject matter and supersede any prior agreements, whether written or oral, regarding such subject matter, aside from what is expressly stated in this section or as explicitly agreed upon in writing between you and Clipping Buzz.
If any provision of the Agreements is found to be invalid or unenforceable for any reason or to any extent, such invalidity or unenforceability shall not affect or render invalid or unenforceable the remaining provisions of the Agreements, and the application of that provision shall be enforced to the extent permitted by law. Clipping Buzz’s or any third party beneficiary’s failure to enforce the Agreements or any provision thereof does not waive Clipping Buzz’s or the applicable third party beneficiary’s right to do so in the future.
Clipping Buzz may assign or delegate any of its responsibilities under the Agreements, and Clipping Buzz may assign or delegate any of its obligations under the Agreements. You may not assign the Agreements or any portion of them to a third party, nor may you transfer or sub-license your rights under the Agreements.
These terms and conditions will be regulated and interpreted in accordance with English law. You consent to the sole jurisdiction of the English courts.
To the fullest extent allowed by law, you agree to defend, indemnify, and hold harmless Clipping Buzz from and against any claims for harm, loss, or expense of any kind (including reasonable legal fees and costs) resulting from: (1) your violation of this Agreement; (2) any User Content; (3) any activity you undertake on or through the Clipping Buzz Site; and (4) your violation of any law or the rights of a third party.
The most recent version of Clipping Buzz’s privacy statement (the “Privacy Policy”) is accessible on the Site and is incorporated herein by this reference. Clipping Buzz highly advises that you carefully read the Privacy Policy.
